What it says the law

The safety requirements for your swimming pool to which the four types of devices provided for by the decree of June 7, 2004 must comply:

  • The protective barriers must be designed, constructed, or installed so as to prevent passage by children under five years of age without adult assistance, to withstand the actions of a child under five years of age, particularly concerning the access locking system, and not to cause injury;
    Covers must be made, constructed, or installed in such a way as to prevent the unintentional immersion of children under five years of age, to resist being climbed over by an adult, and not to cause injury;
  • Enclosures must be made, constructed or installed in such a way as not to cause injury and be such that the swimming pool basin, when closed, is inaccessible to children under five years of age;
  • The alarms must be carried out, constructed or installed in such a way that all activation and deactivation controls cannot be operated by children under five years of age. The detection systems must have a mermaid and not to trigger unnecessarily.

One way for owners to ensure that the equipment they are going to purchase or have installed meets these requirements is to check that it complies with approved standards.

The standards that were approved last December have just been the subject of a revision initiated by the standardization commission (manufacturers, consumer associations, technical organizations), the experiments having revealed the opportunity to clarify or supplement certain provisions.

The Ministry of Economy, Finance and Industry published in the Official Journal of May 2, 2004 (NOR INDI0410046V) a notice relating to the approval of the following four revised standards for the safety of your swimming pool :

  • Barriers (NF P90-306 standard),
  • Alarms (NF P90-307 standard),
  • Covers (NF P90-308 standard),
  • Shelter (NF P 90-309 standard).

Reminder of the advice of prevention

An swimming pool safety device in no way replaces the vigilance of responsible adults, who must exercise constant and active supervision.

They must read and know the safety instructions specific to each safety device. These only ensure the protection of young children when locked (for barriers, covers and shelters) or in normal operating condition (for alarms).

When swimming and around the pool, it is strongly recommended to equip young children with flotation devices (adapted buoy, armbands, floating swimsuits, etc.).

A young child should never be allowed to enter a swimming pool alone, left alone or taken out of sight, even for a few moments.
